We currently only sell our products to businesses or other organizations and not directly to consumers. If you are a consumer please consider buying our products for your organization or contacting us if that is not possible.
The following terms and conditions apply specifically to the purchase and use of Vouchers for use with our Long Covid Tracker App.
Background
Our Vouchers provide a subscription to our Long Covid Tracker App. They can be used either by the purchaser or gifted (example, a School Academy Trust purchasing Vouchers for their Academies).
“We/us/our” refers to Science & Engineering Applications Ltd incorporated and registered in England and Wales with company number 11140695 (see https://scienap.com for further details).
“You/your” refers to the business, company, corporate body, trust or organisation who is sponsoring use of the app by purchasing Vouchers.
The Vouchers are valid for 12 months from the date they are sent to you. We will inform you before a Voucher expires should you wish to renew. You have no obligations to renew the subscription. You cannot cancel the subscription.
Data Protection
You are not involved in personal data collection or processing in any way. We will not share app user’s personal data with you (or anyone) unless the app user gives us specific instructions to do so when using the features in the app. The user controls data sharing. We comply with UK and EU GDPR data protection laws.
Fair Usage
Vouchers grant fair use access to the app.
For schools, we define fair use as up to 1000 people associated with the school in some way, including: any staff, pupils (with adult supervision if under 16) and family members of staff or pupils.
For businesses, we define fair use as up to 1000 of your employees or workers and their families.
We may cap the limit of users (by restricting access) but you will not incur any liability for fees if the user limit is exceeded – we will never charge you for overuse.
If we find it necessary to restrict access due to high usage we will give you the option to either buy additional Vouchers to increase the user limit or we can reset your access codes at any time (we charge an administration fee of £35+VAT to reset codes). It is your responsibility to issue the new codes to valid users.
Correct Name Displayed in the App
The user of the Voucher is responsible to check that all the details they provide to us are correct. If they need to change the organisation name displayed in the App we will charge an administration fee of £35+VAT.
Use of the App outside of the UK
The Voucher user can provide the App for use outside of the UK provided they check local laws to confirm this service is legal in that country. Please ask users outside of the UK to enter “INTER” in place of a postcode because we use this information to inform local NHS health services of the prevalence and severity of Long Covid in their local area. We may also signpost users to local NHS approved services using the postcode they provide. We comply with EU GDPR legislation.
Cancelation
The term of the subscription service purchased using a Voucher is 12 months. It starts on the day we provide you with the Voucher. It can be automatically renewed annually on receipt of the subscription fee at the time. We will provide you with advanced notice and if payment is not received the contract will automatically end.
We reserve the right to cancel this contract at any time for any reason. If we do, we will provide you with 30 days notice and we will refund you on a pro rata basis based on the length of time you have had the App during the subscription period.
Liability
Our total aggregate liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to £1,000, excluding our liability for death or personal injury caused by our negligence; or for fraud or fraudulent misrepresentation.
Variation
We reserve the right to change these terms and conditions at any time. If we do, we will provide you with 30 days notice and give you the option to cancel your subscription free of charge. We will refund you on a pro rata basis based on the length of time you have had the app during the subscription period.
Assignment
We may at any time assign, transfer, charge, sub-contract or deal in any other manner with all or any of our rights or obligations under this agreement.
Governing Law and Jurisdiction
This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
